UTICA – SUNY POLY. On Thursday, a copy of the Student Association – Student Government’s legal entity – internal controls policy was uploaded onto Campus Groups. The release of this policy, which had not previously been publicly available, was done without any announcement or mention during that day’s Club Advisory Board meeting or Senate meeting.

The Student Association, legally known as the SUNY Polytechnic Institute Student Association, is a 501c(3) non-profit corporate entity. The Student Government at Utica (and its subsidiary organizations, clubs, etc.) all exist under this entity. The five-member Board of Directors for the Student Association consists of the Provost (Dr. Abdullah Eroglu), the Vice President for Student Affairs (Brittany Morawiec), the Director of Auxiliary Services (John Reale), and two elected SUNY Poly staff or faculty (currently Alexander Turner and Jennifer George).

Notably, this newly released policy explicitly states that the Board has the authority to revoke previously passed Senate legislation, for reasons including but not limited to violating ‘institutional values’. Student governments are often a place for student advocacy and activism, and while the passage and subsequent Board revocation of student Senate legislation has not occurred in recent times, this level of authority would allow the Board to strike down Senate resolutions that address issues that students and administrators disagree on.

Even more significantly, the policy outlines limits for financial reserves, including club accounts which typically keep their balance year-to-year. The policy defines “excess reserves” as anything above 25% of organizations’ (Student Government, Wildcat Events Board, Wildcat Esports, Wildcat Media, and the Club Advisory Board) annual operating budgets, or anything above 25% of a club’s balance at the beginning of the year.

The policy requires these excess reserves to be spent, or to have an approved plan for spending, within 90 days of the beginning of the academic year. Since this limit is set as a percentage of a club’s balance, this means that all clubs will need to spend or have an “approved spending plan” for 75% of their account funds in the first few months of the fall semester. (To be approved, spending plans need to be submitted to the SGU Advisor within 30 days of the beginning of the academic year.) In addition to these requirements, the policy explicitly states that activation funds will not be distributed to clubs if there is no approved plan or if the plan is not followed.

From an organizations’ perspective, Student Government as a whole cannot exceed 25% of its annual operating budget in reserves under this new policy – approximately $125,000\. SUNY already sets a cap of 100% of annual operating budgets for all SUNY student governments, and it’s not clear why a much lower cap has been set.

The reason for financial reserves is to provide a strong backstop for years in which Student Government goes overbudget, to provide a path to fund larger campus projects or initiatives, or for the situation in which the student activity fee is changed to voluntary. These new financial reserves restrictions require Student Government to reduce their current reserves to no more than $125,000.

Per SUNY guidelines, every two years the entirety of the student body votes on whether or not the student activity fee, which funds all Student Government operations, is mandatory or voluntary.

If changed to be voluntary during the next biannual vote this spring, Student Government would see its operating revenue drop precipitously, as it unlikely more than a few students would want to opt-in to an extra fee.

If this occurred, Student Government would need to spend (assuming 5% of students opt-in to pay the fee) its reserves down to no more than $7,500 next academic year. The year following, in which the student activity fee is still voluntary, Student Government would have not even $8,000 for all of its events, club funding, support staff, and everything else Student Government funds for the campus – 1/75th of its current budget, or about 1.3%.

In addition to these sweeping, potentially calamitous financial reserves restrictions, the policy outlines new requirements for club and organization social media. It requires advisors and Center for Student Involvement staff to be included in “..administrative access and monitoring capacity” for all social media accounts (e.g., Instagram, TikTok), as well as be included in all unofficial communication platforms, explicitly mentioning Discord servers, group chats, and messaging applications.

It is not clear why these new requirements were not mentioned during the weekly Club Advisory Board meeting, which had club policy as its topic. The internal controls policy is not dated, though people familiar with the Board’s operation said it had been passed by both the Board of Directors and SUNY Poly President’s Cabinet in recent weeks.
